Terms of Service

I. Participation in INDIASPEAKS Online Panel Surveys

1.    INDIASPEAKS Online Panel offers registered members the opportunity to participate in online surveys. These surveys are either directly commissioned by product manufacturers themselves or commissioned by market research agencies.
2.    Members who have signed up to participate (referred to in the following as "Respondents") are invited to participate in surveys every two weeks, on an average. The frequency of the invitations depends on, among others, the amount of information given by the members.
3.    The participant is free to choose whether or not to participate in the respective survey.
4.    The participant has no legal right to be invited by INDIASPEAKS Online Panel to participate in surveys.
5.    The participant obligates him or herself to fill out the surveys accurately and in particular to not give any false or absurd answers.

II. Compensation

1.    The participant may receive compensation for a survey that has been filled out completely and truthfully and can be analyzed by INDIASPEAKS Online Panel. The type and amount of this compensation is defined in more detail in the respective invitation e-mail. The compensation can consist of an amount of money or credit, participation in a raffle, or a similar reward.
2.    The survey will automatically end if, after the introductory questions of a survey have been answered, it is found out that the participant does not belong to the requested target group. In this case, a right to compensation only exists if the commissioner expressly guarantees a reward for answering the introductory questions.
3.    The compensation is usually credited to the INDIASPEAKS Online Panel account of the participant within one month after participation. However, INDIASPEAKS Online Panel shall not be liable for any delay whatsoever.
4.    When the participant reaches a minimum account balance of Rupees 500, he can request payment in the form of a gift voucher.  
5.    The credit expires if a participant has not logged into the member's area for six months and has not participated in any surveys. It expires as well if INDIASPEAKS Online Panel membership is terminated before applying for the payment.

III. Data Protection

The privacy of the personal data provided by the members is of the utmost importance to INDIASPEAKS Online Panel

1.    Some surveys require personal data to ascertain whether or not the participant belongs to the target group requested by the commissioner. Even so, no information will be given out that allows the commissioner to personally identify the participant. If the participant's name, address and/or telephone number are asked for in a survey, there is no obligation to provide these data. In all other cases, every piece of information that the participant provides in the context of the survey is analyzed and given out in an anonymous form in which the participant is not identifiable.
2.    If the participant believes that there has been any breach of security such as the disclosure, unauthorized use of your name and password or any other information, you must notify INDIASPEAKS Online Panel immediately by e-mailing at panel This e-mail address is being protected from spam bots, you need JavaScript enabled to view it .

IV. Confidentiality

The participant agrees to hold in strict confidence and to not disclose to any other party information learned in connection with any survey, project, questionnaire or other market research activity related to INDIASPEAKS Online Panel. He will use the information contained in any survey, project or questionnaire strictly for the purpose of discussing and providing market research-related data.

V. Cancellation of participation

Cancellation of participation is possible at all times and can be carried out in the "My INDIASPEAKS Online Panel" area under "Market research settings". Cancellation takes place automatically when INDIASPEAKS Online Panel membership is terminated.
The usernames and password remain the property of INDIASPEAKS Online Panel. INDIASPEAKS Online Panel reserves the right to reallocate your username and password to any one upon the termination of your membership.

VI. Limitation of Liability

INDIASPEAKS Online Panel is only liable for deliberate acts and gross negligence, as well as for the violation of significant contractual obligations; in the last case, however, INDIASPEAKS Online Panel's liability is limited to typically predictable damages.
Notwithstanding above, INDIASPEAKS Online Panel will not be responsible for any damage suffered by Participants from use of the services on this site. This without limitation includes loss of revenue/data resulting from service interruptions as may occur because of any act / omission of the Commissioners. This disclaimer of liability also applies to any damages or injury caused by any failure of performance, error, omission, interruption, deletion, defect, delay in operation or transmission, computer virus, communication line failure, theft or destruction or unauthorized access to, alteration of, or use of record, whether for breach of contract, tortuous behaviour, negligence, or under any other cause of action.
In no event shall INDIASPEAKS Online Panel or the Commissioners be liable for any direct, indirect, incidental, special, consequential or exemplary damages, including but not limited to, damages for loss of profits, goodwill, use, data or other intangible losses arising out of or in connection with the site, its services or this agreement (however arising, including negligence).

VII. Modification of the General Terms and Conditions for Online Surveys

INDIASPEAKS Online Panel reserves the right to change the General Terms and Conditions at any time without any prior information or notice to the Participants and or to the registered users and the use of the site pursuant to the change in the Terms and Conditions will constitute acceptance of such change.

VIII. Legal jurisdiction and address for service

This agreement is governed by the Indian Law, without giving effect to its conflict of laws provisions or your actual state or country of residence. If for any reason a court of competent jurisdiction finds any provision or portion of the Terms of Service to be unenforceable, the remainder of the Terms of Service will continue in full force and effect. The address for service is INDIASPEAKS Online Panel's registered office if both parties are business people. In all other cases, the address for service is determined by the legal provisions.

IX. Severability clause

In the event that one or more provisions of these Terms and Conditions be deemed wholly or partially invalid, the remaining provisions shall remain in full force and effect. Any provision that is invalid shall be replaced with a provision that is as similar as possible to and best meets the intended purpose of the invalid provision.

X. Warranty

INDIASPEAKS Online Panel makes no representations or warranties as to the information that is supplied upon the condition that the Participants receiving same will make their own determination and use their discretion as to its suitability for their purposes prior to use. In no event will INDIASPEAKS Online Panel be responsible for damages of any nature whatsoever resulting from the use of or reliance upon information from this site or the products to which the information refers. INDIASPEAKS Online Panel does not warrant the accuracy or timeliness of the materials on this site and has no liability for any errors or omissions in the materials.

XI. Miscellaneous

These Terms and Conditions constitute the entire agreement between the parties with respect to the subject matter hereof and supersedes and replaces all prior or contemporaneous understandings or agreements, written or oral, regarding such subject matter. Any waiver of any provision of the Terms and Conditions will be effective only if in writing and signed by INDIASPEAKS Online Panel.
